Welcome to Senior Check Buddy LLC (“Company,” “we,” “us,” or “our”). Please read these Terms and Conditions (“Terms”) carefully before using our website at www.seniorcheckbuddy.com (the “Site”) or enrolling in our non-medical companionship, medication verification, and telephone fraud protection check-in services (collectively, the “Services”).
By executing our enrollment profile, purchasing a subscription plan, or utilizing our Site or Services, you (as the “Responsible Party” or designated “Senior Client”) acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Services Description
Senior Check Buddy LLC provides live telephone-based companionship, verbal medication compliance check-ins, senior telephone fraud audits, patient technology coaching, and personal concierge coordination.
Our daily calls are intended to engage the Senior Client, evaluate basic comfort levels, remind them of schedules agreed upon with their family, and verify that they are alert and feeling safe. Summaries are provided to the Responsible Party.
2. No Medical or Emergency Services
Critical Safety Warning
Senior Check Buddy LLC is NOT a medical care provider, licensed nursing service, physical home-health agency, or emergency response dispatcher. Our care companions do not provide medical diagnosis, clinical evaluation, physical physical care, or active medical intervention.
Our medication check-ins are strict verbal prompts (e.g., “Did you remember to take your morning pillbox pills?”) and never constitute clinical oversight. If a Senior Client is experiencing an acute medical emergency, they or their caregivers must dial 911 immediately.
3. Billing and Payment Terms
Services are billed in advance on a recurring monthly or annual subscription basis. Payments are securely processed through our integrated payment provider. It is the Responsible Party's obligation to maintain a valid, updated payment method on file. Failure to make payments on time will result in prompt suspension of daily call routines.
4. Cancellation and Termination
You may cancel your subscription at any time by calling our Albuquerque support center at (505) 616-2288 or sending an email to Info@seniorcheckbuddy.com. Since all plans are billed month-to-month, cancellation will stop future recurring charges. We do not provide prorated refunds for partial months of service already commenced.
5. Client Obligations & Power of Attorney
The Responsible Party represents that they have the lawful authority (including Power of Attorney or legal guardianship where applicable) to contract for Services on behalf of the Senior Client, and that the Senior Client has consented to participate in daily check-in calls.
6. Limitation of Liability
Under no circumstances shall Senior Check Buddy LLC, its officers, directors, employees, or companions be liable for any indirect, incidental, special, or consequential damages resulting from daily companion check-ins, missed calls due to carrier outages, failure of the Senior Client to answer, undetected fraudulent telephone activity, or independent actions taken by the Senior Client. Our aggregate liability is capped at the total fees paid by you to the Company in the three (3) months preceding the claim.
7. Indemnification
You agree to indemnify and hold harmless Senior Check Buddy LLC from any claims, losses, liability, costs, or damages (including attorneys' fees) arising out of your breach of these Terms, incorrect health or living coordinates provided during onboarding, or third-party claims relating to legal authority or Power of Attorney.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and interpreted according to the laws of the State of New Mexico, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms or our Services shall be instituted exclusively in the state or federal courts located in Albuquerque, Bernalillo County, New Mexico.
